It is the process of making the documents out. The aim of it is the documents validation for the following usage abroad. The popular error is the opinion, that one should legalize the documents upon arriving abroad. In actual fact, the documents are the subject to legalization only in the country of issue, that is Ukrainian documents are the subject to legalization only in Ukraine, Russian documents are the subject of legalization only in Russia, Belarusian documents are the subject of legalization only in Belarus and so on.

Consular legalization of the documents in Ukraine is necessary in the case if the country, for which the documents are making out, is not in the following lists:

1. The list of the countries, which have signed Hague Convention.
2. The list of the countries, which have concluded with Ukraine bilateral agreement about legal assistance in civil cases.
Detailed lists with the names of these countries may be seen in table No. 1 and table No. 2 at page “Apostille in Ukraine” of this site.

If the country has signed Hague Convention, the documents may be prepared by the simplified method of legalization, that is certification by Apostille, translation into the selected foreign language and certification of the translation by the notary.

If the country has concluded with Ukraine bilateral agreement about legal assistance in civil cases, it is not necessary to legalize the documents. It is enough to translate the documents into the selected foreign language, and to certify the translation by the notary.

If the country, for which the documents are making out, is not in the above-mentioned lists – it is necessary to conduct the procedure of consular legalization of the documents in Ukraine.

This principle of the documents preparation acts on the basis of international legal framework, though exceptions from the rules have happened in our practice. That is why before execution of the documents, please, consult the organization, where you are planning to present the documents, and reconfirm the method of their execution.
